How Green is Rocky Hill?

The Licensed Data contains certain information pertaining solely to the exterior of the target properties, which information was obtained from a variety of public and other sources reasonably available to EDR. EDR does not assure, warrant, guarantee or assume any liability for the correctness, comprehensiveness, timeliness or completeness of any of such information. It cannot be concluded from the Licensed Data that coverage information for the target and surrounding properties does not exist from other sources. The Licensed Data is provided on an "AS IS" basis. NO WARRANTY EXPRESSED OR IMPLIED, IS MADE WHATSOEVER IN CONNECTION WITH ANY THE LICENSED DATA. EDR SPECIFICALLY DISCLAIMS THE MAKING OF ANY SUCH WARRANTIES, INCLUDING WITHOUT LIMITATION, MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE OR PURPOSE. The user of the Licensed Data accepts all such Licensed Data "AS IS". Licensee acknowledges and agrees that the Licensed Data may be inaccurate or incomplete and is subject to error, delay or change. Reliance upon such Licensed Data shall be at the user's risk.

Licensee acknowledges that in no event shall EDR be liable to Licensee for any direct, special, incidental, indirect, punitive, consequential damages or any other damages of any kind (including, but not limited to, lost profits, trading losses and damages) that may result from the use of the Licensed Data even if EDR or any other party have been advised of the possibility thereof with respect to the Licensed Data. Without limiting the foregoing, in no event shall EDR's aggregate liability under this Agreement exceed $5,000.
